These Terms of Service ("Terms") apply to products and services supplied by P3D Print Ltd, whether ordered through our website, through a quotation, by email, or through another agreed ordering method.

P3D Print Ltd is a company registered in England and Wales under company number 15667703, with its registered office at 2 Crossways Old Worthing Road, East Preston, Littlehampton, England, BN16 1DZ.

Throughout these Terms, "P3D Print", "we", "us" and "our" refer to P3D Print Ltd. "Customer", "you" and "your" refer to the person or organisation purchasing products or services from us.

Our website is hosted by Shopify Inc., which provides the e-commerce platform through which we offer certain products and services.

By placing an order, accepting a quotation or otherwise instructing us to proceed with work, you agree to these Terms together with any product description, quotation, specification or other terms specifically agreed for that order.

Nothing in these Terms affects any statutory rights you may have as a consumer.

1. Our Products and Services

P3D Print designs and manufactures 3D printed products and provides bespoke manufacturing and engineering-related services including:

  • 3D printing and low-volume manufacture;

  • custom and bespoke 3D printed parts;

  • personalised products;

  • 3D scanning;

  • bespoke design and CAD services; and

  • other related manufacturing services agreed with the customer.

The exact scope of bespoke work will be set out in the relevant quotation, correspondence or agreed specification.

2. Orders and Quotations

Products purchased through our website are subject to the product description, price and options displayed at the time the order is placed.

Bespoke work may be provided under a written quotation. Unless stated otherwise, quotations are valid until the expiry date shown on the quotation.

By accepting a quotation and instructing P3D Print Ltd to proceed, you confirm that you have reviewed and accepted:

  • the quotation;

  • any specifications, drawings, files or requirements referred to in it; and

  • these Terms of Service.

Where a quotation specifically draws your attention to a section of these Terms, including the Customer-Supplied Designs and Files section, acceptance of the quotation also confirms your agreement to those provisions.

We reserve the right to decline an order before manufacture begins where we reasonably consider that we cannot safely, lawfully or satisfactorily fulfil the requested work.

3. Prices and Payment

Prices are as displayed on our website or stated in our quotation.

Any applicable taxes, delivery costs or other charges will be shown at checkout or included in the quotation where applicable.

For bespoke work, we may require full payment or a deposit before design or manufacturing work begins. Any payment requirements will be stated in the quotation or invoice.

Additional work requested after a quotation has been accepted may result in additional charges. We will normally agree these with you before undertaking the additional work.

Where an obvious pricing or administrative error has occurred, we may correct the error and contact you before proceeding with the order.

4. 3D Printed Products and Manufacturing Characteristics

3D printing is an additive manufacturing process and differs from processes such as injection moulding or machining.

Unless otherwise specifically agreed, normal characteristics of 3D printed products may include:

  • visible layer lines;

  • seams or start/stop points;

  • minor support or contact marks;

  • slight variations in surface texture;

  • small dimensional variations;

  • minor differences between otherwise identical prints; and

  • slight variations in material shade or appearance between manufacturing batches.

These characteristics are not considered defects where they are within reasonable expectations for the process and do not cause the product to materially depart from its description, agreed specification or intended purpose.

Product photographs are intended to represent our products as accurately as reasonably possible. Screens, lighting conditions, material batches and manufacturing processes may result in minor differences in colour or appearance.

Where a precise colour, surface finish or dimensional tolerance is critical, this must be agreed with us before manufacture.

5. Custom and Bespoke 3D Printing

For custom manufacturing, our quotation is based on the information, files, dimensions and requirements provided to us at the time.

Unless design verification or engineering assessment is expressly included within our scope of work, the customer remains responsible for the underlying suitability and functionality of a customer-supplied design.

Where we manufacture a part accurately in accordance with a customer-supplied design, file or dimensions, we are not responsible for a failure caused solely by an error or limitation within that supplied design.

This may include, for example:

  • incorrect dimensions;

  • insufficient clearances;

  • unsuitable wall thicknesses;

  • incompatible mating parts;

  • an unsuitable material selected or specified by the customer; or

  • a design that does not perform as the customer intended.

This does not apply where P3D Print was specifically commissioned to design, validate or advise upon the relevant feature and the customer reasonably relied upon that service.

For parts where fit, tolerance or functionality is particularly important, we may recommend a prototype or test-fit part before full production.

Changes requested after production has started may result in additional charges for work or material already used.

6. Customer-Supplied Designs and Files

This section applies whenever the customer supplies, uploads, provides a link to, identifies or otherwise specifies a digital design, CAD file, STL, STEP, 3MF, image, logo, drawing or other material that P3D Print is asked to reproduce or manufacture.

By instructing P3D Print Ltd to manufacture from customer-supplied material, you confirm that:

  1. you own the design or material, or have obtained all permissions, licences and intellectual property rights necessary to commission P3D Print Ltd to manufacture the requested item on your behalf;

  2. you have reviewed and will comply with any licence terms or restrictions applying to the design, including restrictions relating to commercial manufacture, reproduction, modification or third-party production;

  3. commissioning P3D Print Ltd to manufacture the requested quantity does not, to the best of your knowledge, infringe any third-party copyright, design right, trade mark, patent or other intellectual property right; and

  4. the information you have provided to us concerning your authority to use the design is accurate.

You grant P3D Print Ltd a limited, non-exclusive permission to access, copy, convert, slice, process and otherwise use the supplied material solely to the extent reasonably necessary to provide the requested service and manufacture the agreed quantity.

Ownership of customer-supplied intellectual property remains with the customer or the relevant rights holder. Providing a file to us does not transfer ownership of that design to P3D Print Ltd.

We will not manufacture additional copies of a customer-supplied design for our own sale or distribution unless we separately have the necessary authority to do so.

P3D Print Ltd does not routinely investigate or independently verify the ownership or licensing history of every customer-supplied design. However, we reserve the right to request evidence of permission or refuse, suspend or cancel work where we have reasonable grounds to believe that manufacture could infringe a third party's rights or otherwise be unlawful.

Where a third-party claim arises directly because the customer did not have the rights or permissions confirmed above, the customer may be responsible, to the extent permitted by law, for reasonable direct losses and costs incurred by P3D Print Ltd as a result.

For business customers, the customer agrees to indemnify P3D Print Ltd against reasonable claims, losses, liabilities and costs arising directly from a breach of the confirmations concerning ownership or permission contained in this section.

Nothing in this section requires a consumer to assume liability that cannot lawfully be imposed upon them.

7. Bespoke Design and CAD Services

The scope and deliverables of bespoke design work will be specified in our quotation or agreed correspondence.

A quotation may include a specified number of design revisions. Work requested outside the agreed scope or additional revisions may be chargeable.

Where we provide a drawing, render, prototype or other design for approval, you are responsible for reviewing information that can reasonably be checked by you, including:

  • wording and spelling;

  • names and dates;

  • dimensions supplied by you;

  • logo choice and orientation;

  • layout; and

  • other customer-specific requirements.

Where an item is manufactured accurately in accordance with a proof or design approved by the customer, a remake required solely because of an error contained in the information approved by the customer may be chargeable.

This does not affect our responsibility for errors introduced by us or our obligation to perform design services with reasonable care and skill.

Intellectual Property in Bespoke Design Work

Pre-existing intellectual property belonging to the customer remains the customer's property.

Unless a quotation or separate written agreement expressly states that intellectual property rights will be assigned to the customer, intellectual property created by P3D Print Ltd during bespoke design work remains the property of P3D Print Ltd.

The customer will receive the right to use the agreed deliverable for the purpose stated or reasonably contemplated by the quotation.

Supply of editable source CAD files, design history, manufacturing files or other working files is only included where expressly stated in the quotation.

Any transfer or exclusive assignment of intellectual property rights must be expressly agreed in writing.

8. 3D Scanning Services

Where you provide an object for 3D scanning, you confirm that you own the object or have sufficient authority to commission its scanning and reproduction.

The deliverables and intended accuracy of the scanning service will be stated in our quotation where relevant.

3D scanning can be affected by factors including:

  • reflective or transparent surfaces;

  • very dark surfaces;

  • inaccessible features;

  • deep recesses;

  • fine surface details;

  • movement or deformation of the object; and

  • the condition and geometry of the original object.

Unless expressly agreed as part of the service, 3D scanning should not be treated as a certified dimensional inspection or metrology service.

Where dimensional accuracy is critical, you must tell us before work begins so that an appropriate method and tolerance can be agreed.

9. Personalisation

Where a product is personalised using text, names, dates, logos, images or other customer-supplied content, you are responsible for checking the information you provide.

Please check spelling, capitalisation, dates and other personalised information carefully before submitting your order.

Where we provide a proof for approval, please review it before approving manufacture.

You also confirm that you have the necessary rights or permission to ask us to reproduce any logo, image, artwork or other protected material supplied for personalisation.

We reserve the right to refuse personalisation that we reasonably believe is unlawful or infringes third-party rights.

10. Cancellation and Change of Mind

Standard Products

Consumers purchasing standard products online may have a statutory right to cancel their order within the applicable cancellation period.

Further details are provided in our Refund Policy.

Custom-Made and Personalised Products

The statutory change-of-mind cancellation right does not generally apply to goods that are made to the customer's specifications or are clearly personalised.

This may include products manufactured using customer-specific dimensions, names, logos, artwork or other bespoke requirements.

Where manufacture has not yet begun, we may nevertheless agree to a cancellation at our discretion.

We will not describe an ordinary standard product as non-returnable merely because we manufacture it to order.

Nothing in this section affects your rights where goods are faulty, not as described or otherwise fail to meet your statutory rights.

Bespoke Services

Where a consumer has a statutory cancellation period for a bespoke service, we will comply with that right.

If you expressly ask us to begin providing a service during an applicable cancellation period, you may be required to pay for the proportion of the service already supplied if you subsequently cancel.

Where legally applicable, if a service has been fully performed during the cancellation period following your express request and acknowledgement, the statutory cancellation right may end once that service has been fully completed.

For work where immediate commencement is requested, the relevant quotation or order confirmation may ask you to expressly request that work begins before the cancellation period has expired.

11. Faulty Goods, Remakes and Statutory Rights

Nothing in these Terms limits your statutory rights.

Goods supplied to consumers must meet the requirements imposed by applicable consumer law, including requirements relating to satisfactory quality, description and fitness for purpose where applicable.

Services supplied to consumers will be performed with reasonable care and skill.

If you believe that an item is faulty or has been manufactured incorrectly, please contact us as soon as reasonably possible with your order details and, where useful, photographs or other information explaining the issue.

Depending on the circumstances and your legal rights, we may offer an appropriate remedy such as repair, replacement or refund.

Where a custom item has been correctly manufactured to a customer-supplied design but does not function because of an error inherent in that design, this will not normally constitute a manufacturing fault unless we had expressly accepted responsibility for the relevant design or suitability assessment.

Damage caused by misuse, modification, incorrect installation, abnormal environmental exposure or use outside the product's stated purpose is not considered a manufacturing defect.

12. Materials, Intended Use and Suitability

Different 3D printing materials have different mechanical, thermal, chemical and environmental properties.

Where relevant to a custom component, you should tell us how and where the item will be used, particularly where it may be exposed to:

  • significant mechanical loads;

  • high or low temperatures;

  • water or chemicals;

  • prolonged outdoor or UV exposure;

  • food or drink;

  • electrical equipment;

  • safety-critical applications; or

  • other demanding environments.

Where the customer specifies the material without asking us to assess its suitability, the customer is responsible for that selection.

Where P3D Print specifically recommends or selects a material based on an intended use disclosed to us, we will exercise reasonable care and skill in providing that recommendation.

Unless expressly described or agreed otherwise, our products should not be assumed to be suitable for medical, life-support, safety-critical or certified engineering applications.

Any product-specific safety information, age guidance, installation instructions or warnings provided on a product page or with a product should be followed.

13. Delivery

Delivery charges and estimated dispatch or delivery information will be displayed at checkout, included in the relevant listing or stated in our quotation.

Production and delivery dates provided for bespoke manufacturing are estimates unless we expressly agree a guaranteed deadline in writing.

We will take reasonable steps to meet agreed timescales and will inform you where we become aware of a significant delay.

You are responsible for providing an accurate and complete delivery address.

Where an order is returned to us or requires re-delivery because an incorrect or incomplete address was supplied by the customer, we may charge reasonable additional delivery costs.

For consumer orders where we arrange delivery, responsibility for the goods remains with us until they are delivered to you or another person identified by you to receive them, except where the law provides otherwise.

If an order arrives damaged or appears to have been lost in transit, please contact us so that we can investigate and provide an appropriate remedy.

For international orders, any taxes, duties or import charges will be handled as stated at checkout or in the applicable quotation.

14. Third-Party Websites and Services

Our website may contain links to third-party websites, services or resources.

We are not responsible for the content, accuracy, availability or policies of third-party websites that we do not control.

Where a customer supplies a link to a design hosted by a third party, including a model-sharing or digital-design platform, the Customer-Supplied Designs and Files section of these Terms applies.

Any licence or other terms attached to a design by a third-party platform or rights holder remain applicable.

15. Intellectual Property Belonging to P3D Print

Unless stated otherwise, intellectual property relating to products designed by P3D Print Ltd, including designs, CAD models, photographs, graphics, website content, branding and other original material, belongs to P3D Print Ltd or is used by us under licence.

Purchase of a physical product does not transfer ownership of the underlying design or intellectual property.

You may not reproduce, manufacture, copy, commercially exploit or distribute our protected designs or digital files without our written permission.

This section does not apply to intellectual property owned by customers or third parties.

16. Reviews, Feedback and Other Submissions

If you voluntarily provide a product review, testimonial, photograph or other feedback for publication, you grant us permission to display and reproduce that submission for reasonable business and promotional purposes.

This permission does not give us ownership of customer-supplied CAD files, private designs or other materials supplied solely for manufacturing purposes.

We may remove or decline to publish submissions that are unlawful, abusive, misleading or infringe another person's rights.

17. Acceptable Use of Our Website

You must not use our website or services:

  • for an unlawful or fraudulent purpose;

  • to infringe the intellectual property or other rights of another person;

  • to transmit malicious software or harmful code;

  • to attempt unauthorised access to our systems;

  • to scrape or interfere with the operation of the website in an unreasonable manner; or

  • to submit deliberately false or misleading information.

We may restrict access to our services where reasonably necessary to prevent unlawful activity, fraud, security threats or serious breaches of these Terms.

18. Privacy

Our handling of personal information is governed by our Privacy Policy, available on our website.

Files, images, contact details and other information supplied as part of a bespoke request may be retained for as long as reasonably required to fulfil the order, deal with queries, maintain appropriate business records and meet legal obligations, in accordance with our Privacy Policy.

19. Events Outside Our Reasonable Control

We are not responsible for delays caused by events outside our reasonable control, such as significant courier disruption, power or communications failures, severe weather, supply-chain interruption or other events that we could not reasonably prevent.

Where such an event materially delays your order, we will contact you and take reasonable steps to minimise the effect of the delay.

Nothing in this section removes any cancellation or refund rights you may have under applicable consumer law.

20. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Nothing in these Terms excludes or restricts a consumer's statutory rights.

For consumers, we are responsible for losses that are a foreseeable result of our breach of these Terms or failure to exercise reasonable care and skill. We are not responsible for losses that are not reasonably foreseeable.

We are not responsible for a failure caused solely by incorrect information, measurements, files or designs supplied by the customer where we have manufactured or performed the service in accordance with those instructions and were not commissioned to verify them.

Business Customers

Where the customer is purchasing wholly or mainly for purposes relating to their trade, business, craft or profession, the customer is treated as a business customer.

To the extent permitted by law, P3D Print Ltd will not be liable to a business customer for indirect or consequential losses or for loss of profit, revenue, business or anticipated savings arising from an order.

Subject to any liability that cannot lawfully be limited, our total liability to a business customer arising from an individual order will not normally exceed the total amount paid or payable to P3D Print Ltd for the order giving rise to the claim.

21. Refusal or Termination of Service

We may refuse or stop work where:

  • payment is overdue;

  • the customer materially changes the agreed scope without agreeing revised terms;

  • continuing the work would be unsafe or unlawful;

  • we reasonably believe the work infringes third-party rights;

  • the customer behaves abusively or threateningly towards us; or

  • another serious breach of these Terms occurs.

Where work is stopped, any refund or amount remaining payable will be determined fairly having regard to work completed, materials committed and the circumstances of the cancellation, together with any applicable statutory rights.

22. Changes to These Terms

We may update these Terms from time to time.

The version applicable to an order will normally be the version made available to you when the order was placed or quotation accepted.

Changes made after a contract has been entered into will not retrospectively alter that contract unless agreed between us or required by law.

The current version of these Terms will be available on our website and will display the date on which it was last updated.

23. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remainder of the Terms will continue to apply.

Where reasonably possible, the affected provision will be treated as modified only to the extent necessary for it to be lawful and enforceable.

24. Governing Law and Disputes

These Terms and contracts between you and P3D Print Ltd are governed by the laws of England and Wales.

If you are a consumer, nothing in these Terms prevents you from relying on any mandatory protections or rights available to you under the laws applicable where you live, or from bringing proceedings in a court available to you under applicable law.

For business customers, the courts of England and Wales will have exclusive jurisdiction, unless otherwise agreed in writing.

If you have a complaint, we encourage you to contact us first so that we have an opportunity to resolve the matter.
